Stamp Duty Land Tax (SDLT)

Legislation surrounding SDLT has become more complex in recent years. A combination of higher rates and the recently introduced 3% additional surcharge has resulted in overpayment of SDLT becoming common place.

SDLT Reclaim Service

Berkshire Wealth’s specialist team is able to expertly review the SDLT on property acquisitions, to ascertain whether clients have paid the correct amount. In many cases, clients have unknowingly paid more SDLT than was due.

Berkshire Wealth provides a ‘No Success No Fee’ reclaim service. Our service includes an initial consultation with each client to collate all of the relevant information concerning the property acquisition. We will then prepare a detailed report based upon that information and if we establish that an overpayment has been made, we submit a detailed claim report to HMRC on the client’s behalf. HMRC will then review a claim as submitted and should it agree with our conclusions, will refund the overpaid SDLT.

The overpaid SDLT will be paid to a Berkshire Wealth LLP’s client account. As soon as funds have cleared our success fee is paid, with the net rebate being immediately paid to the client. From start to finish, a successful claim will typically take approximately 8-10 weeks.

Any rebates of overpaid SDLT are subject to HMRC’s agreement. There is no tax planning involved.
